According to the RIAA, ripping LEGALLY BOUGHT music from a CD to your computer is illegal.



This is the most profoundly stupid court ruling I have heard of in recent memory. Read this, because I guarantee it has an impact on every one of you.

From the Washington Post:
"Despite more than 20,000 lawsuits filed against music fans in the years since they started finding free tunes online rather than buying CDs from record companies, the recording industry has utterly failed to halt the decline of the record album or the rise of digital music sharing.

"Still, hardly a month goes by without a news release from the industry's lobby, the Recording Industry Association of America, touting a new wave of letters to college students and others demanding a settlement payment and threatening a legal battle.

"Now, in an unusual case in which an Arizona recipient of an RIAA letter has fought back in court rather than write a check to avoid hefty legal fees, the industry is taking its argument against music sharing one step further: In legal documents in its federal case against Jeffrey Howell, a Scottsdale, Ariz., man who kept a collection of about 2,000 music recordings on his personal computer, the industry maintains that it is illegal for someone who has legally purchased a CD to transfer that music into his computer.


This is hysterical. With this ruling, the record companies have only managed to further erode their position in the market. Think hard: when was the last time you actually saw someone listening to a portable CD player? No one uses CD players anymore — the CD is inarguably a dead medium, having long been replaced with mp3 players. The only reason people still buy CDs is because they plan to transfer the music to their mp3 players. If ripping a CD was deemed illegal, there would be absolutely no reason to buy a CD anymore. That being said, If this ruling is any indication, it is the RIAA's position that the only way to enjoy music from a CD is to play it on a CD player. According to the RIAA, anything else is a violation of copyright laws.

This is just another example of the record companies refusing to change their business model in the face of an evolving market, instead choosing to cling to the past by abusing the legal system.

Worthwhile Listen: Why? - The Hollows



I like lead singer's crass, cynical delivery and deliberate cadance. He almost sounds like an angry and dissilusioned John McCrea... A Bizarro John McCrae if you will. The song itself has the qualities of your basic rock anthem, yet the dark, twisted imagery found in the lyrics makes for a surreal — even disturbing — listening experience.

Dubstep looks set for its moment in the spotlight, if only the wider world can work out exactly what it is.

I was introduced to this genre very recently through a friend who gave me a track from Burial's Untrue LP. I was blown away by the sonic depth of the piece, with tinny, crackling soul samples expertly meshed with ominous, mile-deep sythesizer riffs set to haphazard, yet steady percussion. It was unlike anything I had heard before, and miles more complex and intriguing than the pure dub reggae I have been listening to of late.

Last night, the good people over at Gorilla vs. Bear posted two tracks from Dubstep artist Pinch's forthcoming album, Underwater Dancehall.
Where Burial's Ghost Hardware has layers upon layers of hissing record samples, the tracks from Underwater Dancehall are far simpler, relying on deep drums, intermittent vocals and bright waves of synthesizer. It all comes together to make for an incredibly heavy, almost bottomless sound. Listening to Brighter Day in particular, I couldn't help feeling almost overwhelmed by the drums, which are so fantastically intense that one cannot help but worry about whether there is any truth to the existence of the dreaded "Brown Note".

All three of the songs I have heard have piqued my interest in Dubstep as a genre, and I look forward to purchasing Underwater Dancehall and Untrue in their entirety. Look for reviews of both albums coming soon. Until then, Listen here to some Pinch (via Gvs.B):

New Breeders Album Dropping in April

4AD is pleased to announce the forthcoming world-wide release of Mountain Battles, the new album from The Breeders on Tuesday, April 8, 2008 (April 7 outside of North America).

The Breeders released their last album - Title TK - back in 2002. Since then, of course, Kim Deal has been part of one of the most highly successful and warmly received music reunions of all time, getting back together with the rest of The Pixies for a series of exhilarating live shows in 2004 and 2005. After that, Kim headed back to Dayton, Ohio to start writing a new record.

Mountain Battles is the result. It's an album which captures all the bittersweet electricity of classic Breeders records like Pod and Last Splash, and which breaks new ground at the same time; classic sounding, yet as relevant and exciting as ever.

Mountain Battles was recorded by Steve Albini at Electrical Audio in Chicago, Erika Larson at Stagg Street, Manny Nieto at Manny's Studio, at Refraze in Dayton and by Ben Mumphrey in the Basement.

The Breeders are : Kelley Deal, Kim Deal, Jose Medeles and Mando Lopez; Jose and Mando are both veterans of the Title TK campaign.

The Breeders will be playing live all over the world in 2008. Their schedule includes performances at Canadian Music Week and SxSW and Coachella, plus full tours in the USA and in Europe.

The Breeders are also set to play a full UK tour in April to mark the release of the album.

New Music - Holy F*ck



I'll admit: the reason I downloaded their album was because of their name. I just couldn't imagine what a band named "Holy Fuck" could possibly sound like. Well, in answer to that question, they sound damn good. They lay down some pretty, upbeat instrumental post-rock which makes for some enjoyable (albiet sometimes challenging) listening.


They also have a unique song writing method that they employ on tour, giving them their signature sound"

"Without rehearsing or arranging parts prior to hitting the stage, Holy Fuck wrote the songs from their album, LP, live on tour. Each time they'd return from tour they'd check into a studio and cathartically capture the energy of the live show, recording the songs that had now taken shape. The only problem was they had too much material. A couple of unfortunate computer hard drive crashes later a good chunk of the material was lost. Maybe this was a good thing as it brought to light recording sessions that would have been otherwise overlooked, like the live satellite radio recording on Verge XM, or “Super Inuit”, taken from a live recording made while on tour with !!!. I am of the opinion that truly great bands should just dissappear after their careers have run their course. Here are two videos for your consideration. Both were from a late night talk show. Same format, same band, same song. 17 years difference. In the first film we see a band at the height of their creative power, still largely unknown. They look excited and glad to be there. In the second, they just look dumpy and sad.

Free EP that doesn't suck : Black Kids - Wizard of Ahhhs

The album sounds like the bastard child of the Cure and Sunset Rubdown, if that child was conceived on a garage floor with 50's doo-wop gold standards playing in the background. I feel like I stretched that analogy a little thin. But that's what they don't pay me the big bucks for.

Advance Screening of No Country for Old Men

I was invited to an advanced screening of No Country for Old Men, the new Cohen brothers film based on the novel by Cormac McCarthy, and I have to say I was pretty impressed with the film. And by pretty impressed, I mean it was fucking awesome. I loved the slow, panning desert cinematography, the spare and realistic dialog, the dry humor all. Perhaps the strongest element in the film, however, was the absolutely terrifying main antagonist, Anton Chigurh, wielding a silenced shotgun (?) and a penetrating captive bolt cattle stunner.

Best movie i've seen in a while. I'd write a full review, but screw that. Just go see it.

So About that Ghostface Concert...

So the show was OK, and Ghostface more or less killed. He's got skill and he's been doing this for years. I'd expect nothing less.



...But the opening act, Witchdoctor, was so abysmally bad that he threatened to ruin the concert before it even began. His lame, obvious rhymes and poor flow (as well as his constant plugging of his new album during his set) only served to suck the energy right out of the room and ruin the rest of the show. I almost laughted out loud when he started rapping about being "real" when at the same time he seemed to embody every bad cliché of modern rap. Not only was his material bad, but he lacked any kind of stage presence, and seemed to fade into the background when his "crew" came onstage. He just looked uncomfortable up there, and had to rely heavily on the also mediocre talents of his douchtastic entourage (I'm looking at you, lanky white guy in the velour track jacket, baggy jeans and "Tigger" flat brimmed baseball cap).

There were times when Witchdoctor tried to get the energy of the audience back, predictably resorting to cheap lines like "Everybody here love getting HIGH!?" or "Raise your lighters in the air, everybody get their motherf*cking lighters in the air!" I felt like I was watching a bad comedian trying to get a cold audience back on his side with inane comments about everyday life. Except instead of "Yeah, I hate airplane food too, I can really relate to this guy!" the desired reaction was "Yeah I love getting mad wasted too! this guy's totally awesome!". It's the oldest cop-out in the history of stage performance and a clear indicator of a complete lack of ability. Yeah. We all like getting drunk, but when you can't rap to save your life, who really gives a shit?

There are artists who are talented, but exist beyond the mainstream by virtue of the fact that their material is too sophisticated or different to sell lots of records. Then there are others who simply lack the talent to break into the music scene. From his performance, I can only guess that Witchdoctor falls in the latter category. But hey, I could be wrong.

Album Review - Radiohead - In Rainbows



4.5/5.0 - Highly Recommended

A short time ago, I was surprised with the news that Radiohead was releasing their seventh studio album, titled In Rainbows. Now, two weeks later, I am listening to the album I have been looking forward to since 2003's Hail To The Thief and I can honestly say it was worth the wait.

This album is defined by its simplicity. Gone are the weird glitchy synthesizers that were arguably used to excess in Radiohead's most recent efforts, replaced instead by simple guitar riffs and muted drums which take a back seat to Thom Yorke's signature falsetto (which itself has been left surprisingly free of any sort of distortion or effect save for reverb). This is Radiohead's sound purified and boiled down to their Platonic form. Tightly produced and still as haunting and beautiful as fans should expect from the band responsible for OK Computer , In Rainbows does not disappoint or feel forced throughout its 43 minute runtime.

It should be noted, however that even with the simplicity of the production, Radiohead has managed to create an array of different sounds in each of their songs which not only reflect an evolution of their music, but also echo earlier iterations of their music. The crunchy electric guitar on 'Bodysnatchers', for example evokes the more mainstream sound seen on Pablo Honey and The Bends, while the orchestral 'Faust Arp' reminds the listener of the cinematic OK Computer.

As far as I am concerned, this album is easily one of Radiohead's better offerings and I would highly recommend it to longtime fans or new listeners.

Album Reccomendation: Chris Joss- You've Been Spiked

4.0/5.0 -- Reccomended

Chris Joss is a one-man band who focuses on sampling and remixing 70's era Jazz and Funk. Released by the Eighteenth Street Lounge label, who also produce Thievery Corporation's music, this album is a ridiculously entertaining fusion of Jazz, Electronic and Funk, which never fails or falters throughout its 50 minute runtime. The whole thing feels like a sountrack to a vintage Blaxploitation movie, if said soundtrack was composed with modern production values by an expert producer.

Tracks of note:
Drink Me Hot - babymaking music, pure and simple.

Wrong Alley Street - Reminds me of a car chase.

You've Been Spiked - Funk as a genre was never famous for featuring much Sitar-playing. This track makes you wonder why.

Riviera 69 - Easily the most relaxed cut on this album, features smooth bass riffs brilliantly punctuated by staccato organ strikes. My favorite.

Theivery Corporation is a DJ/ production duo who thrive in Washington DC's vibrant lounge music scene. They mainly produce downtempo, instrumental and bass-heavy jams relying heavily on influences from Jamaican Dub Reggae, Deep House, and traditional music from Latin America and the Middle East. They are responsible for the excellent albums The Mirror Conspiracy, The Richest Man in Babylon, and their most recent LP The Cosmic Game; all of which are excellent examples of the genre.

Versions is an eclectic collection of remixes done throughout the group's career, and spans musical genres from mainstream rock and pop to indie to to reggae and Latin salsa. The album is truly amazing in this regard; all tracks on this record are unique and vibrant and no single cut stands out as filler.

The album kicks off with Tarana, a mysterious and haunting piece which channels the vocals of Ustad Sultan Kahn, an Indian singer who records traditional Hindi Music. His vocals are expertly overlaid onto Thievery Corporation's mellow beats, which makes for an absolutely mesmerizing, if not slightly ominous, listening experience.

Another gem on this record is their dubbed out remix of Herb Alpert's 'Lemon Tree' which evokes newfound emotion and depth from Apert's trademark frivolous and carefree horn numbers.

Other tracks of note include their remix of Strange Days by The Doors, and Sarah McLauglen's 'Dirty Little Secret' (Note: as a man, I cannot freely admit that I like Sarah McLachlan. However I am secure enough to say that this is a truly beautiful recording.)

Overall, Thievery Corporation has managed to create a vibrant and diverse collection which all contain the group's trademark Downtempo lounge feel, yet still maintain the essentials which made the original songs memorable.

So About that "Roots" Concert...


wait, wtf?


Let me start off by saying that when I bought tickets for the show last week at the 9:30 club, I was expecting a true Roots concert. Having seen them live at Constitution Hall in DC with Lupe Fiasco, I couldn't wait to experience them live in a small venue like the 9:30. However, when I got there, I was disappointed to learn that the show wasn't really focused on the Roots, and in fact was a showcase of lesser-known artists with the roots band performing in the background. That being said, once I got over the fact that I wasn't going to be hearing and of the Roots' own material, the concert ended up being pretty awesome.

The Format of the concert was as follows: Black Thought Emceed the show, introducing the various acts and sometimes performing with them while the Roots band played in the background. MC Lyte, Skillz, and Big Daddy Kane all put on great performances, but Black Thought FUCKING KILLED as always. His dense freestyle raps cemented my opinion that he is hands down one of the most talented MC's out there, an opinion echoed by all of the other artists at various points in the show.

The Roots band was great as usual, especially the tuba player who always cracks me up when I see him on stage. Seriously, the guy takes that tuba and fucking rocks it.

The other artists were entertaining enough, but I found myself looking at my watch at around the 2 and a half hour mark. Seriously, that was one of the longest sets I've ever experienced. It literally went on for 3 and a half hours, which in a standing room only venue like 9:30, gets a little tiresome.

OMFG. Radiohead's new album, In Rainbows, out on October 10th.

So I was expecting to have to wait another few months for the new radiohead album to drop. Imagine my surprise when I went to their web site and found it available for preorder RIGHT F*CKING NOW. How about that.

Currently the album is only being released as a download through their web site. The deal is you can pay now, and reserve some bandwidth for october 10th, when the downloading begins. I'm a bit concerned with what sorts of elaborate Digital Rights Management bullshit they'll undoubtedly choose to include with it, but we'll all cross that bridge when we come to it.

A physical CD is also available for preorder and is being produced for release in early December.

Either way, go ahead and preorder the album here. I did. Sure hope it doesn't suck.

Firesign Theater



If you were wondering what the title of this blog meant, it's an oblique reference to a skit done by the Firesign theater, who were responsible for some of the greatest and most hysterical spoken word albums of the last century. Check out these clips for a sample of their work.

I own all three of these albums (plus two more), and I reccomend each one. They are incredible, especially 'Don't Crush that Dwarf" (both Rolling Stone and All Music give this record 5/5 Stars.)

New Flaming Lips...

I'm a little torn about the new Lips track that's circulating the interwebs of late. Honestly, I'll pretty much take anything they dish out and love it, and this is no exception. Sonic wierdness and nonsensical saccharine lyrics. I Dig it.

However there is a problem: It was recorded specifically for the Good Luck Chuck soundtrack. Yes, Good Luck Chuck: the upcoming film starring the spastic-joke-thieving-king-of-all-douchebags Dane Cook. Placing something so awesome as the Flaming Lips anywhere near this asshole is extremely disconcerting indeed.

In fact, I think I'll just pretend it's a lost B-side track and forget about the Dane Cook-connection alltogether. There. I feel better already.

Radiohead fans waiting patiently for the band’s next album may not have to wait too much longer – or they may.

First, the good news: Guitarist Jonny Greenwood confirmed to Paste that the album is done. The not-so-good news is that the band has no idea when fans will be able to hear it.

“We just had a meeting about that today,” said Greenwood on September 7. “We’re very relieved to have finished recording, now we have to decide what we should do with it.”

Radiohead completed its six-album contract with EMI with 2003’s Hail to the Thief and is currently unsigned. Can anyone say bidding war?



That's cool I guess. I'd probably be more excited if I hadn't already been waiting five years for this new album to drop.

Album Recommendation: Explosions in the Sky - The Earth is Not a Cold Dead Place

Casting off the invisible chains which bind you to the Earth, you let yourself float upwards into the beckoning sky, painted hues of orange, purple, green and red by the setting of the sun. There is no noise but the faint rustling of leaves which move with the passing of a summer's breeze below you as you soar effortlessly towards the coming night. You glide over rolling hills of soft grass, sometimes close enough to reach out your hand and touch the green blur which flows beneath you. Feelings of hope, awe, joy and sadness crest over you as the horizon peels away and you fire into the quiet emptiness of space. That is how one could describe the experience of listening to the beautifully cinematic album "The Earth is Not A Cold Dead Place" by Explosions in the Sky

Lonely guitar licks building to layered duets, punctuated by the fierce marching of drums are the elements which define this album. It ebbs and flows with moments of passionate energy followed by sad interludes which build again to joyful climax, only to fall away once more. There are no vocals to speak of —this effort is entirely instrumental —yet the complexity of emotion which is presented here without the benefit of lyrics is astonishing.

Having experienced a recent tragedy in my own life, I can say that The Earth is not a Cold Dead Place is the perfect companion for even the bleakest of outlooks. It is a recording which reflects the inherent beauty in the world, even when it seems all hope is lost. This may all sound like pretentious bullshit to someone who hasn't had the good fortune of listening to Explosions in the Sky, but I promise you: to listen to this album is to fall in love with it.

New Hotness: St. Vincent

I hadn't heard of St. Vincent before downloading a few tracks off of their new album MARRY ME. Generally, I'm not the biggest fan of this kind of light, Rilo Keilyish/Feistish airy indie-pop. However, something about lead singer Annie Clarke's vocals just works for me, and I dig it. Plus she's cute and plays guitar. Peep this vid:
